Terms of Service

Welcome to Arkborne ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Arkborne mobile application ("App") and related services. Please read these Terms carefully before using the App.

By downloading, installing, accessing, or using Arkborne, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Arkborne, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use the App.

2. Fair Play & Anti-Cheat

Arkborne is designed to reward genuine real-world progress and activity. To maintain fairness and integrity, the following are strictly prohibited:

• Fake Steps/Location: Do not fake, spoof, manipulate, or artificially inflate step counts, GPS location data, or activity tracking information.
• Bots and Automation: Do not use bots, scripts, automation tools, or any third-party software to automate or simulate activity within the App.
• App Modification: Do not modify, reverse engineer, decompile, or tamper with the App, its code, or any underlying systems.
• Exploitation: Do not exploit bugs, glitches, or unintended mechanics to gain unfair advantages or rewards.
• Account Sharing: Do not share your account with others or allow others to use your account to manipulate progress or rewards.

Enforcement: We actively monitor user activity and may review accounts at any time. If we detect any violations of these rules, we reserve the right to:

• Adjust or reset account balances, XP, levels, or rewards
• Suspend or restrict account access temporarily or permanently
• Remove or invalidate inappropriately earned virtual items or currency
• Take legal action when appropriate

Our anti-cheat systems are designed to protect the integrity of the App and ensure fair rewards for all users. We may use automated detection, manual review, and user reports to identify violations.

3. Eligibility & Minors

3.1 Age Requirement

You must be at least 13 years of age to use Arkborne. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

3.2 Users Under 18

If you are under 18 years of age, you represent that you have obtained parental or guardian consent to use the App and agree to these Terms. Your parent or guardian must review and agree to these Terms on your behalf.

3.3 Parental Responsibility

If you are a parent or guardian of a minor using Arkborne:

• You are responsible for supervising your child's use of the App
• You are responsible for all purchases, subscriptions, and charges made on the device or account associated with your child
• You acknowledge that in-app purchases and subscriptions may be made through your app store account
• You agree to be bound by these Terms on behalf of your child

We are not responsible for monitoring or controlling minor users' activity. It is the sole responsibility of parents and guardians to ensure appropriate use of the App.

4. Purchases & Subscriptions

4.1 In-App Purchases

Arkborne offers in-app purchases for virtual currency (Arkgold), gacha items, character skins, and other virtual content. All purchases are processed through your app store.

We do not process payments directly. All payment transactions are handled by the applicable app store, and we do not collect or store your payment information.

4.2 Subscriptions and Auto-Renewal

Some features may be available through subscription plans. Subscriptions will automatically renew unless you cancel them through your app store settings before the renewal date.

• You can manage or cancel subscriptions at any time through your app store account settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to subscription features until the end of the paid period

4.3 Chargebacks and Unpaid Amounts

If a payment is reversed, disputed, or charged back through your payment provider, or if a payment fails:

• We reserve the right to suspend or restrict your account until the issue is resolved
• We may remove virtual items or currency associated with unpaid transactions
• Repeated chargebacks may result in permanent account termination

5. Virtual Items & Content

5.1 License, Not Sale

All virtual items, including but not limited to Arkgold, character skins, items obtained through gacha mechanics, companions, and any other in-app content ("Virtual Items"), are licensed to you, not sold. You do not own Virtual Items; you receive a limited, non-transferable, non-exclusive, revocable license to use them within the App.

5.2 No Real-World Value

Virtual Items have no real-world value and cannot be:

• Exchanged for real money, goods, or services outside the App
• Sold, transferred, or traded to other users
• Transferred between accounts
• Refunded for cash (subject to refund policy below)

5.3 Gacha Mechanics

Some Virtual Items are obtained through randomized gacha/loot box mechanics. The odds of receiving specific items are disclosed where applicable. Results are determined randomly at the time of purchase or acquisition. We do not guarantee specific outcomes or items.

5.4 Modification and Discontinuation

We reserve the right, at any time and for any reason, to:

• Modify, update, or remove Virtual Items
• Change item functionality, appearance, or attributes
• Discontinue certain items or features
• Adjust drop rates, odds, or availability
• Reset, adjust, or rebalance game economy

We are under no obligation to provide notice of changes, though we may do so for significant updates. You acknowledge that Virtual Items may change or be removed at any time.

6. Refunds

6.1 General Refund Policy

All purchases are generally non-refundable. Once a purchase is completed and Virtual Items are added to your account, the transaction is final. This includes purchases of:

• Virtual currency (Arkgold)
• Gacha pulls or loot boxes
• Character skins and items
• Subscriptions (subject to store policies and cancellation terms)

6.2 Store Refund Policies

Refund requests must be submitted through your app store. We follow the refund policies and procedures of your app store and applicable laws.

6.3 Special Circumstances

If you experience issues with a purchase, contact your app store support first. If the store cannot resolve your issue, you may contact us at [email protected]. We will review requests on a case-by-case basis, but we are not obligated to provide refunds except as required by applicable law.

6.4 Applicable Law

Where required by local consumer protection laws (e.g., EU Consumer Rights Directive), you may have additional refund rights. We will comply with all applicable legal requirements.

7. Risk & Liability

7.1 Service "As Is"

Arkborne is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or availability of any content or features
• Warranties that defects will be corrected

7.2 Limited Liability

To the fullest extent permitted by applicable law:

• Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for loss of data, profits, goodwill, or other intangible losses
• We shall not be liable for damages resulting from unauthorized access, use, or alteration of your account

7.3 Third-Party Services

The App may integrate with third-party services (e.g., payment processors, analytics, cloud storage). We are not responsible for the availability, accuracy, or reliability of third-party services. Your interactions with third parties are solely between you and the third party.

8. Account Termination

8.1 Termination by Us

We may suspend, restrict, or permanently close your account if you:

• Violate these Terms or any applicable laws
• Engage in cheating, fraud, or abusive behavior
• Harm other users, the service, or our reputation
• Fail to pay required fees or have repeated chargebacks
• Use the App in any way that we determine is harmful or illegal

8.2 Effect of Termination

Upon termination of your account:

• Your right to access and use the App will immediately cease
• All Virtual Items, progress, and data associated with your account may be permanently deleted
• We are under no obligation to restore or refund any Virtual Items or purchases
• You remain liable for all charges incurred prior to termination

8.3 Termination by You

You may stop using the App at any time by deleting the App and canceling any active subscriptions through your app store. If you wish to delete your account data, contact us at [email protected].

9. Changes to Terms and Service

9.1 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last updated" date at the top of these Terms
• Posting a notice in the App or on our website
• Sending an email to the address associated with your account (if applicable)

The most current version of these Terms will always be available on our website. Continued use of the App after changes constitutes acceptance of the modified Terms.

9.2 Changes to Service

We reserve the right to modify, update, or discontinue any aspect of the App at any time, including:

• Features and functionality
• Virtual Items and their availability
• Pricing, subscriptions, and in-app purchases
• Server availability and maintenance schedules

We are not obligated to provide notice of all changes, though we may do so for significant updates. The website always has the current version of these Terms.

10. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, and the compilation thereof, are the property of Arkborne or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit any content from the App without our prior written consent.

11. User Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Harass, abuse, threaten, or harm other users
• Impersonate any person or entity or falsely claim affiliation with any person or entity
• Interfere with or disrupt the App or servers connected to the App
• Attempt to gain unauthorized access to the App, accounts, or computer systems
• Use automated systems (bots, scrapers) to access the App
• Transmit viruses, malware, or other harmful code

Violation of these rules may result in immediate account termination.

12. Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts having jurisdiction over the matter, as determined by applicable law.

14. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arkborne regarding your use of the App and supersede all prior agreements and understandings.
